Terms and Conditions

1.Agreement to Terms

By participating in the Massive Collapse alpha playtest program ("Alpha Playtest"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, you may not participate in the Alpha Playtest. These Terms are entered into between you and Modern Mammoth LLC ("Company," "we," "us," or "our").

2.Alpha Playtest Program

The Alpha Playtest is a pre-release testing program for Massive Collapse, a video game currently in development. By participating, you acknowledge that:

• •The game is in an early, unfinished state and may contain bugs, errors, and incomplete features
• •Game content, features, and mechanics are subject to change without notice
• •Your participation does not guarantee access to the final release version of the game
• •Access to the Alpha Playtest may be revoked at any time at our sole discretion

3.Eligibility and Access

To participate in the Alpha Playtest, you must:

• •Be at least 18 years of age (or the age of majority in your jurisdiction)
• •Have a valid Steam account and Discord account
• •Submit accurate information in your playtest request
• •Be accepted into the program by Modern Mammoth LLC

Access to the Alpha Playtest is granted at our sole discretion. We reserve the right to deny or revoke access to any participant for any reason, including but not limited to violation of these Terms, inappropriate behavior, or failure to provide accurate information.

4.Steam Key Activation

If approved for the Alpha Playtest, you will receive a Steam key via Discord direct message. You acknowledge that:

• •The Steam key must be manually activated in your Steam account
• •The game will not be automatically added to your Steam library
• •Steam keys are non-transferable and may not be sold, traded, or shared
• •Each Steam key is intended for use by a single individual only

5.Confidentiality and Non-Disclosure

As an alpha playtester, you may have access to confidential information about the game, including but not limited to:

• •Unreleased game content and features
• •Development plans and roadmaps
• •Internal discussions and communications
• •Bug reports and technical information

You agree to maintain the confidentiality of all such information and not to disclose, share, stream, record, or publicly discuss any aspects of the Alpha Playtest without our prior written consent, except as may be explicitly permitted in our Discord server guidelines.

6.Feedback and Bug Reports

We encourage you to provide feedback, bug reports, and suggestions through our designated channels (e.g., Discord server). By submitting feedback, you:

• •Grant Modern Mammoth LLC a perpetual, irrevocable, worldwide, royalty-free license to use, modify, and incorporate your feedback into the game
• •Understand that we are under no obligation to implement your suggestions
• •Agree that all feedback becomes the property of Modern Mammoth LLC

7.Code of Conduct

As a playtester, you agree to:

• •Treat all participants, developers, and community members with respect and courtesy
• •Refrain from cheating, exploiting bugs, or engaging in any activity that disrupts the testing experience
• •Follow all guidelines and rules set forth in our Discord server
• •Report bugs and issues in good faith and in accordance with our reporting procedures
• •Not engage in harassment, discrimination, or any form of toxic behavior

Violation of this code of conduct may result in immediate removal from the Alpha Playtest program.

8.Intellectual Property

All content, including but not limited to game code, assets, graphics, music, text, and trademarks, are the exclusive property of Modern Mammoth LLC or its licensors. Your participation in the Alpha Playtest does not grant you any ownership rights or intellectual property rights in the game or any related materials.

9.Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MODERN MAMMOTH LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR PARTICIPATION IN THE ALPHA PLAYTEST.

The game is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

10.Termination

We reserve the right to terminate or suspend your access to the Alpha Playtest at any time, with or without cause or notice, for any reason, including but not limited to:

• •Violation of these Terms
• •Violation of our code of conduct
• •End of the Alpha Playtest program
• •Technical or operational reasons

Upon termination, your right to access and play the Alpha Playtest will immediately cease.

11.Changes to Terms

We reserve the right to modify these Terms at any time. We will notify participants of material changes via Discord or email. Your continued participation in the Alpha Playtest after such modifications constitutes your acceptance of the updated Terms.

12.Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Modern Mammoth LLC is incorporated, without regard to its conflict of law provisions.
